The topic: "Taxation of Business and Asset Transfers - Old Dogs and New Tricks"
Business transfers are some of the single most important and complex transactions that an entity can undertake and if executed well can generate significant value for all the parties involved. However, the competing interests of the buyer and seller had led to novel consideration structures being employed. The Australian Taxation Office (ATO) has some controversial views on how different consideration structures should be taxed. The Government has also proposed some changes which could have a major impact on the way the consideration for these major transactions are structured.
Mark Molesworth will review the current state of play, suggest how the proposed changes could impact the structuring of future business transfers and provide some guidance on how to manage a transaction in an environment of uncertainty.
